1. Who you are contracting with

English by Design is operated by Omar Bach Toubdji Andueza, a sole trader based in Barcelona, Spain ("English by Design", "we", "us", "our"). You can reach us at omarbach1998@gmail.com.

These Terms & Conditions form a binding agreement between you and Omar Bach Toubdji Andueza for your use of the englishbydesign.es website, our downloadable guides and workbooks, and our private English lessons and teacher-training services (together, the "Service").

2. Acceptance of these terms

By accessing the website, purchasing a digital product or booking a class, you confirm that you accept these terms. If you do not agree with them, please stop using the Service.

If you are purchasing on behalf of a school, academy or company, you confirm you have authority to bind that organisation. If you are purchasing as an individual, you confirm you are of legal age in your country, or that a parent or guardian is entering into these terms on your behalf.

3. What we provide

We provide (a) digital learning materials such as the Nailing the FCE Writing workbook, delivered as downloadable files after purchase; (b) live one-to-one and small-group English classes delivered online or in person; and (c) materials and support for teachers and academies.

Digital products are licensed, not sold. On payment you receive a limited, non-exclusive, non-transferable licence to use the material for your own personal learning or, where the product is sold for classroom use, with your own students.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in breach of applicable law
• engage in fraud, spam, or misrepresentation of your identity or payment details
• copy, resell, redistribute, publish or share our guides, worksheets or lesson materials beyond the licence granted above
• infringe anyone's intellectual property rights
• interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, scraping content, or circumventing technical or access limits
• reverse engineer or attempt to derive the source of any part of the Service

5. Accounts, bookings and accurate information

You are responsible for keeping any login or download link confidential and for activity that takes place under your account or links issued to you. You agree to give accurate information (including a valid email address) when purchasing, and to keep it up to date, so we can deliver your product or class.

Class bookings are made through our scheduling link. Classes purchased in bundles must be used within 3 months of purchase. Classes cancelled with less than 24 hours' notice are treated as delivered and are not refundable.

6. Intellectual property

All content in the Service — including guides, workbooks, worksheets, lesson plans, website copy, images, the English by Design name, logo and branding — remains the property of Omar Bach Toubdji Andueza or its licensors. Nothing in these terms transfers ownership of any intellectual property to you.

Where you submit your own work to us (for example writing tasks for feedback), you keep ownership of it and grant us a limited licence to store and process it solely in order to provide the Service to you. If you believe material on this site infringes your rights, email omarbach1998@gmail.com and we will review and, where appropriate, remove it. Repeat or serious infringement will end your access.

7. Service availability

We work hard to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or free of inaccuracies. Learning materials are educational resources; they do not guarantee any particular exam result or grade. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payments, billing and taxes

All orders are sold directly by English by Design (Omar Bach Toubdji Andueza), the seller and merchant for every order. Payments are processed on our behalf by Stripe; card details are entered on Stripe's secure checkout and are never seen or stored by us. All customer service, including delivery issues and returns, is handled by us at omarbach1998@gmail.com.

Prices are shown in euros and include any applicable VAT unless stated otherwise. Your receipt or invoice is issued by us and delivered by email after payment. Cancellations and refunds are governed by our Refund Policy.

Prices for classes are shown per class on the relevant page and may change for future purchases; changes never affect classes or bundles you have already paid for.

9. Suspension and termination

We may suspend or end your access to the Service, in whole or in part, if you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate the acceptable-use rules above. Where it is reasonable to do so, we will contact you first and give you a chance to put things right.

You may stop using the Service at any time. On termination, your licence to use our materials ends and outstanding amounts remain payable; files you have already downloaded lawfully may be kept for your own personal use.

10. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special losses, including loss of profits, revenue, data, goodwill or exam outcomes. Our total aggregate liability arising from or in connection with the Service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law. You agree to indemnify us against claims arising from your unlawful use of the Service or your breach of these terms.

11. Changes to these terms

We may update these terms to reflect changes in our products or the law. The updated version will be posted on this page with a new date, and continued use of the Service after that date means you accept the revised terms.

12. Governing law and disputes

These terms are governed by the laws of Spain, and the courts of Barcelona, Spain have jurisdiction over any dispute, without affecting any consumer rights you have to bring a claim in your country of residence. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or business transfer.
